February 18, 2010 Minutes

 

The Telford Borough Authority Meeting held this date was called to order at 6:00 p.m. by Chairman Timothy Hagey, with the following members in attendance: Abram Diehl, Nelson Moll and Thomas Taglang.  Also present were Borough Manager Mark D. Fournier, Recording Secretary Megan McShane, Solicitor Mark Weand, Engineer Patrick DiGangi, and Public Works Director Donald Beck.

DISCUSSION ITEMS:  

 

1.     M&M Stone Quarry Update:        

Solicitor Mark Weand reported on the federal suit.  Four separate briefs (one for each defendant) were filed by the attorney representing the group members sued including the Authority insurance company attorney and copies of these briefs were distributed to the Authority.  Solicitor Weand thought these briefs were all very compelling and that they should carry more weight since they were filed separately.  He stated that the briefs are now before Federal Court and that he anticipates a response within six months. 

       

Solicitor Weand also reported that he, Mark Fournier and Pat DiGangi met with DEP and their attorney on February 2nd.  A comparison will be done of what

Telford Borough has submitted cost-wise to what the Borough can recover.  When the quarry officially closes, the Borough will recover some of its costs, but it will be less than what we contributed.        

M&M has filed with the Environmental Hearing Board to reconsider their adjudication; the decision is currently before the Board.  

 

2.     TMDL Update:        

Solicitor Mark Weand reported that the stay order is still in place; nothing is proceeding with our appeal.  John Hall and his group have been trying to request a meeting with DEP and EPA representatives.  John Heinz (DEP) has agreed to meet on March 25th, March 30th or March 31st.  

 

 

3.     Right-of-Way Clearing Project:        

Mark Fournier reported that the Borough is preparing to send letters to homeowners requesting that they remove any fences, sheds or other items from the right-of-way easements on their properties.  He expects to receive negative feedback and estimates that this process will take about six months.  JDM has agreed to remove material when the weather cooperates.         

 

Engineer Pat DiGangi and Solicitor Mark Weand have prepared utility easements for MetPro and Telford Developers, Inc. for the right-of-way clearing project.  Mark Fournier will attempt to secure these easements.  A Taglang / Moll motion was carried unanimously (4-0) giving permission to Mark Fournier and Timothy Hagey to execute the Agreements for MetPro and Telford Developers, Inc.  

 

4.     Well # 6        

Engineer Patrick DiGangi reported that the project is almost complete from a design and permitting perspective.  The necessary modifications were made to the piping in the well house to allow bypass water to be metered.        

A backflow device is being put on to prevent cross contamination.        

The project will go out for bid once the design and specifications are complete.  The Engineer estimates that the project will cost between $50,000 and $60,000.  

 

REPORTS:  

 

TREASURER’S REPORT:  accepted as presented  

 

Mark Fournier reported that in the month of January, the Borough had 1.93% revenues, spent 7% of our 2010 expenditures and that the audit was recently completed. 

WATER DEPARTMENT REPORT:  We received a written report for the file.

Public Works Director Donald Beck reported that based on the Authority’s metered sales for the first quarter, our unaccountable water loss was at 1%. 

COLLECTION REPORT:  We received a written report for the file.

The Borough will be meeting with Mr. Groff at Hilltown Township next week to get a better understanding of reading the Southern District meter pit on a more frequent basis.   

WASTEWATER TREATMENT REPORT:  We received a written report for the file.

PWTA REPORT:  We received a written report for the file.

 

SOLICITOR’S REPORT:  We received a written report for the file.

 

ENGINEER’S REPORT:  We received a written report for the file.

Engineer Patrick DiGangi reported that CKS is currently working on plan reviews for TEVA Pharmaceuticals, Lutheran Community at Telford and Myco Mechanical.  CKS is also working on punchlists for Harleysville Bank and Univest.  

 

 

MANAGER’S REPORT: Mark Fournier reported that he met with Hatfield Township Municipal Sewer Authority regarding the type of insitu repairs, which was very helpful.  

 

OTHER BUSINESS:  

 

Permission for Mark Fournier, Donald Beck and Todd Mathe to attend the PWRA Conference was approved unanimously (4-0) by a Moll / Taglang motion.  

 

Mark Fournier presented a memorandum from the Franconia Sewer Authority requesting Telford Borough Authority to determine that they have the capacity for a 2 EDU commercial use in the Earlington Area.  The request was approved unanimously (4-0) by a Moll / Taglang motion.  

 

 

Mark Fournier reported on the status of two Authority employees who are unable to move forward with securing their licenses due to restrictions that the state has made.  He asked the Authority to consider the situations of these two employees and stated that he will come back to the Authority with a formal recommendation for adjusted pay at a future date.   Payment of the bills and requisitions for the month of January in the amount of $236,030.16 was approved unanimously (4-0) by a Moll / Taglang motion.                

         

A Taglang / Moll motion carried unanimously (4-0) authorizing the signing of the checks.  The meeting was adjourned unanimously (4-0) with a Diehl / Taglang motion.
