October 15, 2009 Minutes
 

The Telford Borough Authority meeting held this date was called to order at 6:07 p.m. by Chairman Timothy Hagey with the following members in attendance: Thomas Taglang, Abram Diehl and Nelson Moll.  Also present were Borough Manager Mark D. Fournier, Recording Secretary Cathy Fried, Public Works Director Donald Beck, Engineer Patrick DiGangi, and Solicitor Mark E. Weand, Jr.   

 

A Diehl / Moll motion carried unanimously (4-0) approving the September 17, 2009 minutes.

 

COMMENTS FROM AUDIENCE:  none

 

 DISCUSSION ITEMS:

1.         Stream Bank Stabilization Update:

 

Engineer Patrick DiGangi reported the project is complete and went well.  He presented pictures of the work done on Keystone Drive.  Manager Mark Fournier, Patrick DiGangi and Public Works Director Donald Beck remarked that the contractor, Enviro-Air Technologies, Inc., did a good job.  

  

2.         Well Development Discussion:

 

Mark Fournier commented a study completed by David Fennimore of Earth Data Northeast, Inc. was included in tonight's packet.  There was a brief discussion concerning the cost of proceeding with well development and whether or not well development should be pursued at this time.  It was the general consensus that the topic of well development be postponed until the June 2010 Authority meeting.

 

3.         M&M Stone Quarry Update:

 

            Solicitor Mark Weand reported Judge Gardner has dismissed the M&M suit in federal court; therefore, the pump test will not be performed on Well #4.  There is a 30-day appeal period.  The M&M appeal regarding the temporary discharge permit that was revoked by DEP was dismissed on September 17th. 

            There was further discussion as to restoration of Well #4.  Mark Fournier explained the process necessary to put Well #4 back in service.  Patrick DiGangi commented he has received a proposal from Severn Trent regarding arsenic treatment and media replacement.  Timothy Hagey questioned what costs are involved to bring Well #4 back online.   

  

4.         Pipeline Relining Project Update:

 

            Engineer Patrick DiGangi reported this project is currently being completed.  There will be a change order for this project because it was necessary to install a bench in a manhole.   

        

5.         Grant & Bill of Sale Coventry Meadows Phase I:

 

            Mark Fournier reported the work is complete for this project.  Funds will be held in a maintenance bond.

 

            A Moll / Taglang motion was carried unanimously (4-0) authorizing Mark Fournier and the appropriate officials to sign the easement agreements and the grant and bill of sale.

 

6.         Grant & Bill of Sale Village at Rosecliffe:

 

            A Moll / Taglang motion was carried unanimously (4-0) authorizing Mark Fournier and the appropriate officials to sign the easement agreements and the grant and bill of sale.

 

 7.        Lutheran Community at Telford Update:

 

            A Taglang / Moll motion was carried unanimously (4-0) to approve plans for Lutheran Community at Telford dated October 9, 2009 and the planning module subject to approval of the Manager, Engineer, and Solicitor.

 

REPORTS:

 

TREASURER REPORT: accepted as presented

 

WATER DEPARTMENT REPORT:   

 

Water

 

1.   Wells - Daily maintenance and record keeping were performed.  Samples were dawn and tested as required.

2.   GIS Mapping - GIS Mapping of the water system continues as staff time allows.

3.   Leak Detection - Nate Stauffer from FTC completed a leak survey of our distribution system.  During the survey, we located one main line leak, three service leaks, and four hydrant leaks.  Since repairing these leaks, we are able to reduce our daily pumping by 60,000 - 70,000 gallons per day.

4.   Water Main Repairs - On 9/17 we repaired a broken 6" CI main at 414 N. Main Street.  On 10/1 we repaired a cracked 6" main at 416 N. Main Street.

5.   N. Main Street Water -Installation of the new 8" DIP water main between Lenape Lane and Church Avenue is complete except for the tie-in at Church Avenue.  Also, the service lines to the houses have been transferred to the new main and the old 6" main has been taken out of service.  We plan to install base restoration during the last week in October, with the wearing course deferred to spring 2010.

 

Sewer

1.   Collection System - See collection system operator's report.

2.   GIS Mapping - GIS Mapping of the sewer system continues as staff time allows.

3.   North Main Street Sewer Project - Curb and sidewalk repairs will be coordinated with the trench restoration in late October to complete construction aspects of this project.

 

Public Works Director Donald Beck reported the North Main Street Project is nearing completion.  The Reliance Road paving will be done next week.  He also reported there has been a problem with a water sample at the South Storage Tank.  It is believed the problem is a result of low chlorine residual.  The tank will be disinfected next week so that it can be put back online.

COLLECTION SYSTEM REPORT: 

 

LIFT STATIONS:

 

I check both lift stations daily and check the bacteria and Ph weekly.

I had the grease removed at both lift stations this month.

I started to add soda ash at the South Lift Station to try to keep the Ph in line and to help the bacteria work better.

I was called in on September 27th for a power outage at the North Lift Station.  It was determined to be a PP&L problem on one of their poles. Bill Mattson came in and we set up the Godwin pump.  The electric was off for 4 hrs. When the new lift station was built, it was designed with an emergency electrical outlet for a generator. After a discussion with Mark and Don I've set up a meeting with Scott from West Generators concerning what we need and the cost for a portable generator for that location and possibly the wells.

I replaced the manhole casting at the south lift station.

I mowed the grass at the south station on a weekly basis.

 

MAINS:

 

Swerp, Inc. is continuing with the lateral relining on Reliance Road.

I reinstalled data loggers in mh 77 and mh 149-3 collecting post data that I e-mail to CKS weekly.

I helped the road crew by being flagman on the County Line sewer replacement.

 

HOME INSPECTIONS:

 

I inspected nine properties during the month of September and discovered two violations.

I'm continuing to load inspection data on my computer.

 

Ms4:

 

I am continuing to collect inlet data and loading it on my computer.

 

MISCELLANEOUS:

 

I made a plumbing inspection of a sewer lateral on Keystone Drive.

I marked out a PA One Call on Carousel Drive for PP&L.

I attended an EPWPCOA meeting at Oaks Wastewater Treatment Plant.

Thomas Taglang asked if SWERP, Inc. has completed the Pipeline Relining Project.  Patrick DiGangi reported they are finishing the manholes.

WASTEWATER TREATMENT REPORT:

 

Operations

 

•·    Total effluent flows recorded for the month of September was 19,954,000 gallons for an average flow of 665,100 gallons per day.

•·    We generated 72 tons of Bio-Solids for field disposal in the month of September.

•·    Checked stream and outfall area on a weekly basis.

•·    There were no violations to report on our August 2009 DMR.

•·    We finished up all sampling and testing on our Bio-Solids for the current year and distributed all pertinent data to the appropriate organizations for review.

•·    AquaticLab, Inc. sent us a copy of the results from our first round of Wet Testing on our final effluent.  We had favorable results which is very encouraging.  This testing is a requirement for our NPDES permit renewal application.

•·    Gary's Septic pumped out grease and cleaned both the North Lift Station and South Lift Station and deposited the contents into Digester #2 for disposal.

•·   We took the plant's SCBA unit down to Breathe Safe for a yearly inspection for recertification as required.

•·   The road crew staff took our loader over to the shop to replace the rear tires with a set of new tires that we purchased from Bergey's.

 

Maintenance

 

•·    We pumped down the Lime Mixer Tank and cleaned out any debris and inspected all the components for wear as required.  There were no problems to report at the present time.

•·    We had to disassemble Blower #3 and take it over to Sampey's to investigate a loud vibration we heard while it was in operation.  A preliminary investigation has shown a bearing was starting to fail prematurely.  At the present time we are still investigating as to why this occurred.

•·    We had Tyson & Son drop off our rebuilt Jet-Vac pump that is utilized in our disinfection system.  We put the pump back in service.

•·    Due to a problem we had to disassemble the drive motor on our #2 polymer unit.  We sent the motor over to Tyson & Son to be rebuilt.  They installed a new capacitor and new bearings as required.  We received the motor back and reinstalled it.  The whole unit is currently back in service.

•·    We had Todd Mathe in to replace the control unit for the plant's water softener as required.

 

Personnel

 

•·     I attended the EPWPCOA September meeting with Bob Kratz.

•·     I attended a three day seminar entitled Utility Management Institute at the Doylestown Township Municipal Building.  I found this program to be very resourceful and informative.

   

Mark Fournier reported the Sludge Hauling Project is out for bid.  Bid opening is scheduled for Friday, October 30th.

 

PWTA REPORT:   We received a written monthly report for the file.

 

Abram Diehl mentioned the letter sent by PWTA requesting information necessary to reconcile EDU's.  He said it has been recommended that future reconciliations may be done on a more frequent basis in the future.

 

SOLICITOR'S REPORT:   

 

1.    WELLHEAD PROTECTION PROGRAM.  There remains no Township contact.  Accordingly, there is nothing to report. 

2.    WWTF.  Operation aspects and facility related matters continue to be reviewed with the Manager and Engineer. 

3.    INFLOW AND INFILTRATION.  The I&I Abatement Plan Semi-Annual Status Report for the period February 2009 through July 2009 was submitted to DEP by the Authority Engineer on September 10, 2009.  An I&I reduction has been noted and referenced.

4.    HILLTOWN INTERCONNECT AGREEMENT.  An Interconnect Agreement with the Hilltown Township Water and Sewer Authority remains pending. 

5.    COVENTRY MEADOWS I.  (A) The quantity take-offs have been provided to the Solicitor by the Engineer.  The Grant & Bill of Sale for the Water and Sanitary Sewer Facilities has been prepared by the Solicitor and approved by the Manager.  The documents will be submitted to the developer by the Engineer for signature and return along with the Maintenance Bond.  (B)  Two Utility Easement Agreements are required.  The easement information previously submitted for document preparation does not match the "as-builts" as submitted.  Accordingly, the developer's engineer has been contacted to confirm accuracy or submit revised legal descriptions and plot plan attachments.

6.    COVENTRY MEADOWS II (METZGER TRACT).  There continues to be no update.  The Service and Escrow Agreements have not been returned.

7.    WISTERIA COURT (KONYK TRACT).  This John Garis nine lot subdivision along Clymer Avenue basically remains idle.  Accordingly, there is no update at this time.

8.    VILLAGE AT ROSECLIFFE.  (A) Quantity take-offs have been provided to the Solicitor by the Engineer.  The Grant & Bill of Sale for Water and Sanitary Sewer Facilities has been completed by the Solicitor.  The Grant was reviewed by the Manager on October 7, 2009 and approved for submission by the Engineer.  A Maintenance Bond should be returned with the signed Grant & Bill of Sale.  (B)  Easement Agreements are required.  The Engineer has provided review comments to the developer.  Once the legal description and easement plans have been corrected, the Solicitor will prepare Easement Agreements for Bucks County recording.

9.     WOODSPRING MEADOWS (STEINHAUER TRACT).  John Garis continues building out this thirty-two (32) unit townhouse development along Clymer Avenue.  Otherwise, there is nothing specific to report.

10.  HARLEYSVILLE SAVINGS BANK.  Facility construction is moving along well.  As referenced, legal aspects have been completed.

11.  UNIVEST BANK, ROUTE 113.  Construction of the bank facility is progressing.  The structure has been framed out.  Easement Agreements will be prepared when additional information is received.

12.  COUNTY LINE ROAD W/S MAIN REPLACEMENT.  Public works personnel are in the process of finishing water service connections and restoration.  No legal aspects are required at this time. 

13.  BUDGET.  The Manager is in the process of preparing the 2010 Budget.  Certain  aspects have been discussed with the Engineer and Solicitor.

14.  SELLERSVILLE WATER INTERCONNECT.  An Interconnect Agreement remains pending with the Solicitor.

15.  WELL NO. 4 LITIGATION.  (A) Supreme Court of Pennsylvania.  There has been no decision by the Pennsylvania Supreme Court on the M&M Petition for Allowance of Appeal filed on January 5, 2009.  (B) United States District Court. The M&M suit was dismissed as to all parties and all counts by Court Order of United States District Judge James Knoll Gardner entered on September 30, 2009.  The Order was accompanied by a comprehensive 47 page Opinion.  Accordingly, the Order entered by Judge Henry S. Perkin on July 20, 2009 allowing a pump test of Well No. 4 by M&M becomes moot.  (C) Bucks County Litigation. The Bucks County litigation remains pending, however, it is uncertain if this suit now has any merit in view of the Opinion and Order of the Federal Court which based its decision on the merits rather than jurisdiction.  (D) Temporary Discharge Approval.  On September 17, 2009, Judge Bernard A. Labuskes, Jr. entered an Order dismissing the appeal of M&M Stone Co.  The adjudication indicated that the appeal from the Department's recision of the Temporary Authorization to Discharge Water was moot since the authorization expired by its own terms, and as a matter of law the Board could offer no further relief. 

16. ARSENIC REMEDIATION.  As previously referenced, the arsenic remediation design for Well No. 4 has been completed by CKS. 

17.  SOUTH SEWERAGE LIFT STATION.  The exchange of flows by gravity which would eliminate two existing lift stations remains pending upon the development of the former school district property.

18.  GIS MAPPING.  A GIS mapping presentation will be presented to the Authority by CKS at the November meeting. 

19.  WEST ROCKHILL TOWNSHIP PROPOSALS.  (A) The Solicitor has received no updated pertaining to a special PWTA meeting to consider the West Rockhill Township proposal for participation.  (B)  At recent meeting, the Manager and Chairman conferred with West Rockhill Township officials to discuss service to the Almont area. 

20.  TEVA.  Following "conditional approval" by the Authority at last meeting, the Manager initiated required submissions for project service.  The Solicitor is now in receipt of sufficient information for preparation of Service and Escrow Agreements.

21.  TMDLs.  (A)  On September 9, 2009, the Manager, Chairman and Solicitor attended the Science Advisory Board meeting on EPA Nutrient Criteria Guidance conducted in Washington, D.C.  The Manager presented very effective testimony pertaining to cost impacts and ability to achieve MS for compliance.  Subsequently, the Solicitor has received and reviewed submissions pertaining to SAB commentary.  The SAB has 90 days within which to submit written comments stating its official position.  In the interim, efforts are being advanced requesting TMDL withdraw.  

22.  LUTHERAN COMMUNITY AT TELFORD.  The Manager has been meeting with representatives of the Lutheran Community to review plan revision aspects.  Dependent upon the timeliness of resubmission, a second presentation to the Telford Borough Planning Commission could occur on October 21, 2009.  In the interim, the Manager and Engineer intend to schedule a special meeting to reconcile flow rates for the new facility as the Lutheran Home submission does not coincide with the Authority records.

23.  SANITARY SEWER RELINING PROJECT.  The project is not totally finished as a few saddles are required.  The interceptor lines will then be subject to a pre and post construction monitoring.  The contractor was compliant and cooperative.  Basically, the project went well with the exception of unexpected construction configuration at some connection points.

24.  STREAM BANK STABILIZATION.  The project has been completed.  The contractor has received compliments from the Manager and Engineer for the quality of the work performed.  Payment approval will be submitted at the next Authority meeting.

25.  TAPPING FEE CALCULATION.  The Engineer has completed in draft form a new format for water and sanitary sewer use regulation.  The Telford Borough Ordinance revision will be an update of what currently is in place. 

26.  WELL NO. 6.  (A) No leakage has been experienced with regard to the three replacement fittings.  (B)  The media replacement by Severn Trent has been scheduled for next week or in the alternative, the last week of this month.  (C)  The plans and specifications with regard to the backwash disposal to the sanitary sewer system have basically been completed by the Engineer.  The purchase of Endress-Hauser meters will be subject to bid.

27.  GROUND WATER RESOURCE DEVELOPMENT.  The Manager, Engineer and Solicitor have discussed this project with the Chairman for direction.  This endeavor will represent an addendum item for discussion at the next Authority meeting.

 

Solicitor Mark Weand reported that Judge Krancer has been assigned to the TMDL appeal with the Environmental Hearing Board. 

ENGINEER'S REPORT:  We received a written monthly report for the file.

 

MANAGER'S REPORT: 

  

  • Met with the Authority Engineer and Solicitor to coordinate various project reviews and construction projects.
  • Conducted an inspection of the Sanitary Sewer Relining Project.
  • Conducted inspections of the Stream Bank Stabilization Project.
  • Attended the TMDL Science Advisory Board meeting for testimony in Washington, DC.
  • Attended a meeting with the Authority Chairman and West Rockhill Township officials to discuss future water and sewer service issues and areas.
  • Budget preparation.

Mark Fournier reported he is working on the Authority budget.  Nelson Moll remarked it will be prudent to be careful in spending.  Mark Fournier further explained the method and cost of developing a system of rapid notification that will be added to the budget for 2010.  Mark Fournier also presented stuffers that will be mailed to water / sewer customers with their quarterly invoices.  It was the consensus of the Authority that the stuffers be mailed twice a year and that the stuffers contain pertinent information.

 

OTHER BUSINESS: 

 

Payment of the bills and requisitions for the month of September in the amount of $206,029.40 was approved unanimously (4-0) by a Moll / Taglang motion.

 

A Dieh / Moll motion was carried unanimously (4-0) authorizing the signing of the checks.
