The Telford Borough Authority meeting held this date was called to order at 6:00 p.m. by Chairman Timothy Hagey with the following members in attendance: Abram Diehl and Nelson Moll. Thomas Taglang was absent. Also present were Manager Mark D. Fournier, Utility Billing Clerk Diane Windfelder, Public Works Director Donald Beck arrived at 6:10 p.m., and Engineer Patrick DiGangi arrived at 6:15 p.m.
A Diehl / Moll motion carried unanimously (3-0) approving the July 16, 2009 minutes.

DISCUSSION ITEMS:
1. Stream Bank Stabilization Update:
Manager Mark D. Fournier reported that the Stream Bank Stabilization Project was awarded to Enviro-Air Technologies and in reviewing the plans and the site, we will need to raise the gabion wall from 6 to 9 ft high in certain areas along Old State Road to the rear of the Stevens property. This project should begin next week.
2. TMDL Update:
Manager Mark D. Fournier reported that he and Mark Weand have been in Norristown in court for the last three days. Mr. Fournier indicated that the next step is the EPA Science Advisory Board Presentation which will be held on September 9 - 11th.
A Moll / Diehl motion carried unanimously (3-0) authorizing to pay our portion of the science advisory board presentation & research to the legal defense team.
3. M&M Stone Quarry Update:
Manager Mark D. Fournier reported that the Supreme Court has not rendered a decision, and Judge Henry Perkin entered an order permitting M&M Stone Quarry to conduct a pumping test of our Well #4.
4. TEVA Update:
Patrick DiGangi reported that TEVA has submitted revised plans and they are currently under review. Mr. DiGangi also reported that TEVA is receptive to the Authority's position regarding the inspection, the escrow that is required, and number of required sanitary sewer EDU's including an extra 19 EDU's currently being used by the existing facility.
5. Pipeline Relining Project Update:
Patrick DiGangi reported that the Pipeline Relining Project is moving right along. All the mains are completed but they are having problems relining some of the laterals. At this time, they will be reviewing the videos and making a decision on the affected laterals and this will be discussed at the next Authority meeting.
REPORTS:
TREASURER REPORT: accepted as presented
WATER DEPARTMENT REPORT:
WATER
1. Wells - Daily maintenance and record keeping were performed. Samples were dawn and tested as required.
2. GIS Mapping - GIS Mapping of the water system continues as staff time allows.
3. Well #7 - We are waiting for a new subtrol from Franklin Motors to complete repairs to Well #7.
4. Distribution System Flushing - This is a completed item for 2009.
5. Water Main Repairs - On Friday, 8/14, we will be replacing a fire hydrant at Indian Crest Jr. High. The existing hydrant was damaged by the contractor removing portable classrooms and we will be billing the school district for the new hydrant.
6. North Main Street Water Main Replacement - Pipe, valves and fittings have been ordered for this project. We will begin construction after completing the sewer main work in progress.
7. Services - On 7/22 we installed a new ¾" service to 2990 State Road.
8. Harleysville Savings Bank - Our 8" water main along South County Line Road serving the new Harleysville Savings Bank site must be relocated due to conflicts with the propose storm drains and a lack of sufficient cover over the existing main.
After various meetings with the general contractor, excavation contractor, architect, design engineer, township engineer, CKS representatives, and myself, it was determined to relocate approximately 280' of 8" main. The installation of control valves and T's is planned for Thursday night 8/13/09.
Sewer
1. Collection System - See collection system operator's report.
2. GIS Mapping - GIS Mapping of the sewer system continues as staff time allows.
3. Sewer Lateral Cleanouts - We completed observation c.o.'s at 711, 709 & 707 S. County Line Road.
4. North Main Street Sewer Project - We began replacing main, m.h.'s, and laterals along North Main Street between Lenape Lane and Church Avenue on 7/20/09. So far we have installed approximately 420' of 8" PVC main, 2 m.h.'s and 6 laterals with observation c.o.'s. Progress is being hampered by rain, PennDot regulations, trench conditions, vacation schedules, and various other work items. We hope to complete installation by the end of August.
COLLECTION SYSTEM REPORT:
LIFT STATIONS:
I check both lift stations on a daily basis and the bacteria on a weekly basis. The ph is checked on weekly at the South Lift Station weekly.
I had the grease pumped out from the South Lift Station.
Verizon repaired the phone line at the North Lift Station.
LRM installed the new alarm system at both lift stations and service with American Security has been terminated.
HOME INSPECTIONS:
Twenty two homes were inspected during the month of July. No violations were found. Letters were sent out reminding residents reminding them to make an appointment.
MAIN:
I read data loggers and e-mailed data to CKS weekly.
I also discussed new locations for the data loggers with T.J. at CKS.
I gathered data for T. J. for the next I & I Abatement .
I attended the pre-construction meeting for the pipeline relining project.
C & S Landscapers mowed the easements that we cleared the last two years.
Chris Darrah and I made a punch list for the Sewer Diversion Project.
The pipeline relining job started.
I helped Donald Beck set up the by-pass pump for the sewer line replacement on County Line Road.
MS4:
I finished installing the NO DUMPING markers on all the inlets in the borough (350) and started to collect data .
I designed an attribute table for all the inlets in the system and have started to down load data.
MISCELLANEOUS:
I marked out PA One Calls in Green Meadows and Bridle Run for Verizon Fios.
I repaired the door lock on the garage at well #1.
I read water meters for Todd while Chris was out with an injured ankle.
I temporally repaired a window at the Community Building.
I was out for one week of vacation.
WASTEWATER TREATMENT REPORT:
Operations
- Total effluent flows recorded for the month of July was 22,217,000 gallons for an average daily flow of 716,700 gallons per day.
- We generated 48 tons of Bio-Solids for the month of July.
- Checked stream and outfall area on a weekly basis.
- There were no violations to report on our June 2009 DMR.
- Moyer and Son came in and cleaned and inspected the facilities boiler. There were no major problems discovered at the present time.
- Bearing & Drives Unlimited, Inc. returned our rebuilt oxidation ditch drive box unit. We now put this unit back on the shelf, to be used as a backup when needed.
- Gary's Septic pumped out grease from our South Lift Station and deposited it in Digester #2 for disposal.
- At the request of the Montgomery County Health Department we constructed a spray system on the walls of the Chlorine Contact Tanks to make the water surface turbulent. They feel this will help control the mosquito population found to be developing around standing water. So far we have had positive feedback.
- We took the plant pickup truck to Wheels Automotive for its yearly inspection.
Maintenance
- Our staff emptied Digester #2 and cleaned out the rags and grit that had accumulated on the floor and over the air diffusers. No problems were found at the present time.
- Derstine Company LLC came in and sandblasted and painted the center drums and framework assemblies of both Final Clarifiers. This job was a budget item.
- We replaced the window in the Chlorine Room door that was required.
- We painted the interior walls in the Grit Removal Building.
- Swartley Brothers came in to wire up a new motor for the belt drive gearbox on our Belt Filter Press as required. We ordered another motor from Bearings & Drives Unlimited to be put on the shelf as a backup when needed.
Personnel
- I would like to take this opportunity to acknowledge my crew on the fine job they did while I was away on vacation. They worked hard and got a lot accomplished while being shorthanded over the course of my vacation. Great Job guys.
PWTA REPORT: A written monthly report was received for the file.
SOLICITOR'S REPORT:
1. WELLHEAD PROTECTION PROGRAM. There remains no Township contact. This item, however, will continue to be referenced by reason of the importance of the Wellhead Protection Program to the Authority.
2. WWTF. The oxidation ditch shaft replacement has been completed. The gear box has been repaired. However, there exists a seal leak. Otherwise, facility-related aspects continue to be reviewed with the Manager and Engineer.
3. INFLOW AND INFILTRATION. Although the Authority staff continues to collect data, CKS is currently working on the next semi-annual status report, which is due September 30, 2009.
4. HILLTOWN INTERCONNECT AGREEMENT. An Interconnect Agreement with the Hilltown Township Water and Sewer Authority remains pending.
5. INTERZONE TRANSFER PROJECT PHASE II (RELIANCE ROAD SURCHARGE). As previously reported, this project has been completed. The final payment to the contractor will be made this week.
6. COVENTRY MEADOWS I. (A) CKS has performed a final inspection of the offsite portion of the sanitary sewer distribution system constructed as a part of the Coventry Meadows I project. A punch list referencing fifteen points was submitted to the Developer on July 31, 2009. (B) The sanitary sewer as-built plan, as prepared by the Developer's engineer has been received by CKS. Following review, six points were referenced as necessary corrects or additions by correspondence dated June 22, 2009.
7. COVENTRY MEADOWS II (METZGER TRACT). The Service and Escrow Agreements as submitted by the Solicitor have not been returned by Developer's legal counsel.
8. WISTERIA COURT (KONYK TRACT). There is no report as construction proceeds slowly in this John Garis nine lot subdivision along Clymer Avenue.
9. VILLAGE AT ROSECLIFFE. The Developer is still working on completion of "punch list" items. .
10. WOODSPRING MEADOWS (STEINHAUER TRACT). Construction continues in this John Garis thirty-two (32) unit townhouse development along Clymer Avenue.
11. HARLEYSVILLE SAVINGS BANK. The contractor is continuing with site work and replacement of existing facilities. As previously referenced, legal aspects have been attended to by the Solicitor.
12. UNIVEST BANK, ROUTE 113. (A) The Service and Escrow Agreements for this project were signed by the Authority at meeting on July 16, 2009. Payment of Authority fees has been made. (B) Current parcel numbers and deed references are required for the Solicitor to complete the Three Easement Agreements pertaining to this project.
13. COUNTY LINE ROAD W/S MAIN REPLACEMENT. The Authority staff started this project approximately two weeks ago. However, due to weather conditions several working days were lost. Work has started on the lateral replacement which will be redesigned so that the library service is separated from the Landis service.
14. BUDGET. Budget aspects are referenced with the Manager and Engineer as various projects are discussed.
15. SELLERSVILLE WATER INTERCONNECT. An Interconnect Agreement remains pending with the Solicitor.
16. WELL NO. 4 LITIGATION. (A) Supreme Court of Pennsylvania. A decision has not been rendered on the M&M Petition for Allowance of Appeal filed on January 5, 2009. (B) United States District Court. (i) The Court has not ruled on the Motions to Dismiss the Amended Complaint as filed by all party defendants. (ii) On July 20, 2009, Judge Henry S. Perkin entered an order permitting M&M to conduct a pumping test of TBA Well No. 4 in accordance with the protocol submitted to the court by Douglas R. Blazey, Esquire, on June 11, 2009. There has been no contact by M&M subsequent to the issuance of this order by the United States Magistrate Judge. (C) Bucks County Litigation. There has been no activity. It is projected that there will be no activity until there is a determination in the pending federal suit. (D) Temporary Discharge Approval. The Solicitor has not received M&M's Reply Brief which was due for filing on August 4, 2009. A Sur Reply Brief by DEP/TBA is due August 31, 2009.
17. ARSENIC REMEDIATION. As previously referenced, the arsenic remediation design for Well No. 4 is complete and awaits implementation.
18. M&M LAND DEVELOPMENT. Since there continues to be no contact from M&M following review meeting on July 22, 2008, this item will be deleted from further report.
19. SOUTH SEWERAGE LIFT STATION. There remains no activity to report on the exchange of flows by gravity which would eliminate two existing lift stations.
20. GIS MAPPING. Data continues to be collected by CKS and the Authority staff for completion of the GIS water system mapping.
21. WEST ROCKHILL TOWNSHIP PROPOSALS. The Solicitor has no update with regard to the West Rockhill Township proposal for participation in the PWTA facility.
22. TEVA. Following contact by legal counsel for TEVA, a review meeting was conducted on July 14, 2009. On July 16, 2009, the Solicitor and Engineer participated in a conference call with Stephen Altemore, who advised that TEVA would accept the position of the Authority with regard to inspection, escrow, and number of required sanitary sewer EDUs. A written memorandum was prepared for the Manager. Written confirmation will be provided by TEVA once the financing is in place.
23. TMDLs. (A) The Solicitor continues to review extensive submissions pertaining to all TMDL aspects. (B) The hearing on the Board's jurisdiction remains pending for August 17, 18 and 19, 2009 and on August 21, 2009 if necessary. The Manager has been advised that his testimony is projected for August 19, 2009. This testimony will relate to cost impacts and ability to achieve MS for compliance. (C) The testimony of EPA staff person Jon Capacasa has been scheduled for September 3, 2009, with motion denied to preclude his testimony by reason of deposition refusal. (D) The Solicitor has received and reviewed the pre-hearing memorandums filed by the various parties addressing proposed witnesses/exhibits and responding to the legal issues raised by Judge Miller in prior EHB order.
24. LUTHERAN COMMUNITY AT TELFORD. The Solicitor attended the formal plan presentation by the Lutheran Community to the Telford Borough Planning Commission on July 14, 2009. Extensive review comments were prepared by CKS to which the Lutheran Community responded with a "will comply" format. Very few waivers appear to be necessary in view of the scope of this project. Items requiring resolution, such as fire company and recreation contributions are being discusses. It is projected that a second Planning Commission meeting will take place in August with possible presentation to Borough Council for approval at its September 8, 2009 meeting. The foregoing pertains to the development of what is designated as Phase I.
25. SANITARY SEWER RELINING PROJECT. At recent review meeting the Solicitor was advised that the relining project is ahead of schedule, with the contractor doing a good job.
26. STREAM BANK STABILIZATION. The contract was awarded by the Authority at meeting on July 16, 2009. Following notice by CKS, Enviro-Air Technologies Incorporated has returned the required paperwork. Accordingly, a preconstruction meeting will be scheduled.
27. TAPPING FEE CALCULATION. The Engineer continues to work on a format for water and sanitary sewer use regulation which will also require revision of the Telford Borough Ordinance.
28. WELL NO. 6. (A) No leakage has been experienced with regard to the three replacement fittings. The Engineer has received certification that the fittings are US made. (B) following the Engineer's Media Replacement Comparison Report, the Authority awarded the proposal to Severn Trent on July 16, 2009. The proposal has been reviewed at recent meeting with the Manager and Engineer to assure propriety. The proposal as drafted will be signed and submitted by the Manager so that the replacement initiative may commence. (C) It is projected that the water will be blended after meters are installed in conjunction with the next contract which deals with backwash disposal to the sanitary sewer system. Backflow prevention devices will also be installed.
29. GROUND WATER RESOURCE DEVELOPMENT. The Solicitor has received the Earth Data correspondence dated July 2, 2009 setting forth several properties with sufficient potential for future ground water development. Steps to be followed and a description of the work were delineated in eight phases. As discussed at the last Authority meeting, it is the intent to move forward with this initiative. The manager will confer with W. David Fennimore, P.G., to discuss cost refinement.
ENGINEER'S REPORT: We received the written monthly report for the file.
