July 16, 2009 Minutes
 

The Telford Borough Authority meeting held this date was called to order at 6:00 p.m. by Chairman Timothy Hagey with the following members in attendance: Abram Diehl and Nelson Moll.  Thomas Taglang was absent.  Also present were Recording Secretary Cathy Fried, Public Works Director Donald Beck, Solicitor Mark E. Weand, Jr., and Engineer Patrick DiGangi.

 

A Diehl / Moll motion carried unanimously (3-0) approving the June 15, 2009 minutes.

 

COMMENTS FROM AUDIENCE:  none

 

 DISCUSSION ITEMS:

1.         Stream Bank Stabilization Bid Award:

 

Engineer Patrick DiGangi reported the bids were opened for the Stream Bank Stabilization Project on June 25th.  There were nine (9) bids with the lowest bid being submitted by Enviro-Air Technologies in the amount of $47,270.65.  Patrick DiGangi reviewed the bid and contacted references.  He found the bid to be in order and recommends the Authority award the bid for the project to Enviro-Air Technologies.

 

A Moll / Diehl motion was carried unanimously (3-0) to award the bid for the Stream Bank Stabilization Project to Enviro-Air Technologies in the amount of $47,270.65.

 

2.         TMDL Update:

            The testimony of Jon Capacasa, a DEP employee, has been scheduled for September 3rd.  The status report from attorney John Hall was included in the packet for tonight's meeting.   

       

3.         M&M Stone Quarry Update:

 

            Solicitor Mark Weand reported a decision from the PA Supreme Court is still pending.  The motions to dismiss filed with the federal court remain pending with the court.  M&M is continuing to request a pump test of Well #4.  The issue with the Temporary Discharge Approval remains unresolved.  Mark Weand has received a copy of the Post Hearing Brief submitted by DEP in this Environmental Hearing Board case. 

            Engineer Patrick DiGangi asked when the judge will rule on whether to pump test Well #4.  Mark Weand responded there is no definite time frame.  Nelson Moll questioned the amount of money expended on this case and when will it end.  Mark Weand said that everything that needs to be done has been done. 

4.         Well #6 Media Replacement Discussion & Update:

 

            Patrick DiGangi reported he has received the proposals for media replacement from Siemens and Severn Trent.  He compared the proposals as to life of the media and warranty with life expectancy being one of the important factors in both proposals.  He further reported that Solebury Township has decided to contract Severn Trent for the same media replacement.  Patrick DiGangi reported the Severn Trent proposal is the most cost effective.  The media is nearing the point where replacement is imminent.  Severn Trent could be onsite in 4 weeks and they also dispose of the expended media.

 

            A Diehl / Moll motion was carried unanimously to award the replacement of the media for Well #6 to Severn Trent in the amount of $42,500.

 

            Patrick DiGangi also discussed blending.  He feels the Authority should consider blending because that will use less bed volume.  Blending would require metering of water being put through the system.  The fittings for the arsenic treatment equipment at Well #6 were delivered and have been replaced by Siemens.

 

5.         Well Development Report:

 

            Timothy Hagey referenced the report by David Fennimore of EarthData Northeast, Inc. that indicates the costs related to well development.  Summit Park and Stover Park are considered viable for testing.  He will discuss this information with Manager Mark Fournier and consult the budget.

 

6          TEVA Update:

            Patrick DiGangi reported TEVA would like to connect their new building and new pump station to our sanitary sewer.  They will need an additional 152 EDU's.  Nelson Moll asked for their time frame.  Mark Weand reported TEVA would like to phase the project. Phase I will be the force mains and they would like to begin construction in September. Mark Weand reported service agreements will be required.  TEVA has agreed to our requirements regarding the issues of escrow and inspections. 

 

REPORTS:

TREASURER REPORT: accepted as presented.

WATER DEPARTMENT REPORT:   

 

WATER

 

1.   Wells - Daily maintenance and record keeping were performed.  Samples were dawn and tested as required.

2.   GIS Mapping - GIS Mapping of the water system continues as staff time allows.

3.   Well #6 - At this time, there has been no progress by Siemens in regard to replacing the leaking fittings in the Arsenic Treatment system.  Also, we are exploring various options to address the iron levels in the backwash water.

4.   Distribution System Repairs - On May 12th we replaced a leaking service to 209 S. Main Street.  On May 27th we replaced the water service at 255 N. Main Street.

5.   New Services - On May 13th we installed a new water service for the Lutheran Home duplex at Washington Street and Crestview Drive.  On May 14th - 15th we installed a new 6" main at the Telford Fire House to supply their proposed fire sprinkler system.

6.   Distribution System Flushing - On May 19th we began our annual flushing of the water mains and hydrants.  We are approximately 60% complete and expect to finish by the end of June.

Sewer

 

1.   Collection System - See collection system operator's report.

2.   GIS Mapping - GIS Mapping of the sewer system continues as staff time allows.

3.   2009 Sanitary Sewer Diversion Project - All sewer main, manhole and water main construction work is complete.  The contractor, Passerini & Sons, Inc., must install the final trench restoration to complete this project.

 

Donald Beck explained he has changed the format of his report by updating the Authority portion prior to the Authority meeting so the content is current.  He reported the sewer lateral cleanouts on South County Line Road have been completed.  The trees at the North Lift Station have been removed.  The North Main Street water and sewer replacement is scheduled to begin next week.

 

Donald Beck distributed to the Authority a proposal for the utility truck he would like to purchase to replace the 1989 utility truck presently in service.  It is not necessary to have this item bid because we are using the piggy-back program through Costars.  The 2009 budget has allotted $50,000 for this item.  The proposed price of the utility truck is $58,286.32.  A discussion was held as to the proposed use of this truck.

 

A Moll / Diehl motion was carried unanimously (3-0) approving the purchase of a 2010 utility truck through PA Costars. 

 

COLLECTION SYSTEM REPORT:   

 

LIFT STATIONS:

 

Checked both lift stations daily and checked bacteria weekly. I had the grease pumped out of the South Lift Station.

I plan to start checking the PH at the South Lift Station on a weekly basis to determine how to get a better end result with the grease problem.

Mark Fournier and I met with Tony from LRM about alarm systems for the lift stations and about eliminating American Securities. Tony has a better system that will cost less than the system we are presently using. The LRM system will dial from a phone list directly to us rather than American Securities who then calls me. And, it will also let me check the system using my laptop. A discussion was held between Donald Beck, Mark Fournier, Todd Mathe, and me.  We decided to go with Tony's quote and ordered one for each lift station.

K&A repaired a leak with high pressure grout at the North Lift Station.

The two trees along the south property line of the North Lift Station were cut down at the request of the neighboring property owner.

 

HOME INSPECTIONS:

 

Sixty nine inspections were completed during the month of June; eleven violations were discovered and two repairs have been made.  I sent out another mailing to selected residents of Fourth Street and North Main Street.

 

MS4:

 

All the inlets were shot for GPS and e-mailed to CKS and I started to install the inlet markers.

 

MAINS:

 

K&A tv'ed the last run in the system that needed to be done between m.h. 153-A and 150 as well as repairing a leak in m.h. 150-3 with grout.

I installed both data loggers collecting pre data for the slip lining project and e-mailed the data to CKS weekly.

I scheduled a date with Chad Clemens from C&S Landscaping to mow the sewer easement right of way during the second week of July.  The hourly rate is the same as last year.

I marked out the sewer mains at Green Meadows via PA One Call.

 

MISCELLANEOUS:

 

I helped Todd Mathe distribute Consumer Confidence Reports to various organizations within Telford Borough.

I read the wells for Todd while he was flushing water mains.

 

WASTEWATER TREATMENT REPORT:   

 

Operations

 

•·    Total effluent flows recorded for the month of June was 25,444,000 gallons for an average daily flow of 848,100 gallons per day.

•·    We generated 96 tons of Bio-Solids for the month of June. 

•·    Checked stream and outfall area on a weekly basis.

•·    There were no violations to report on our May 2009 DMR.

•·    Swartley Brothers, Inc. came in and replaced the plant's underground fuel tank leak detector sensor as required.  This sensor is installed between the inner and out walls of the tank and can sense the presence of moisture that may accumulate due to a leak.

•·    We took the gear box that had been replaced on the Oxidation Ditch to Bearing & Drives Unlimited, Inc. for an overall rebuilding as required.

•·    We signed and returned the contract to Aquaticlab, Inc. to perform the upcoming Wet Testing that will be a requirement to renew our current NPDES Permit.

•·    Moyer and Son, Inc. delivered fuel oil to our underground tank as required.

 

Maintenance

 

•·    Our staff changed oil and greased various pieces of equipment around the plant for the summer season as required.

•·    Our crew installed a new air line for main compressor up in the garage.  This will free up the portable compressor that was currently being used and will assist our crew when they are working on various projects at the garage.

•·    We had to disconnect the suction side piping header for Primary Pump #1 and take it to Sampey's to have a leak repaired.  They welded a piece of steel over the underside of the elbow.  We painted the patch and reinstalled the header immediately.  The pump is currently back in operation.

Personnel

 

•·    I had the opportunity to attend a one day with Todd Mathe entitled Water Distribution Components.  This class gave me credit hours toward my current water license as required.

•·    Nick Windfelder started his summertime hours with us on June 22, 2009.  On behalf of our staff I would like to welcome him to Telford Borough.

 

I will be away on vacation with my family from July 15, 2009 until July 28, 2009.  The plant will be left in very capable hands while I'm away.

 

Abram Diehl asked if there have been any problems due to the amount of rainfall.  Donald Beck explained there have been no issues because storm modes have been of a short duration and because of the diversion project.

 

PWTA REPORT: 

      

Abram Diehl referenced information he had previously faxed to Mark Fournier.  He reported there have been 2 more responses to PWTA regarding the West Rockhill Township request for membership to PWTA.  Abram Diehl also reported PWTA will release an additional 476 EDU's.

 

SOLICITOR'S REPORT:  

1.        WELLHEAD PROTECTION PROGRAM.  There remains nothing to report by reason of lack of Township contact. 

2.         WWTF.  Operation aspects and facility related matters continue to be reviewed with the Manager and Engineer.  The oxidation ditch shaft replacement and gear box repair have been subject to specific discussion.

3.         INFLOW AND INFILTRATION.  In anticipation of the next I&I Abatement Plan semi-annual status report due September 30, 2009, CKS and Authority staff continue to relocate the meters for data collection.

4.          HILLTOWN INTERCONNECT AGREEMENT.  An Interconnect Agreement with the Hilltown Township Water and Sewer Authority remains pending.

5.         INTERZONE TRANSFER PROJECT PHASE II (RELIANCE ROAD SURCHARGE).  This project has been completed.  The contractor is attending to final detail without formal notice.  CKS has not processed final payment at this time.

6.        COVENTRY MEADOWS I.  CKS has received the "as-builts" from the Developer.  The Developer is currently attending to four completion items for the Authority to accept dedication.  Following dedication, the residences on Keystone Drive with failed systems will be connected to the sanitary sewer line.

7.        COVENTRY MEADOWS II (METZGER TRACT).  There remains no update as the Service and Escrow Agreements as submitted by the Solicitor some time ago have not been returned by Developer's legal counsel.

8.        WISTERIA COURT (KONYK TRACT).  Construction in this John Garis nine lot subdivision along Clymer Avenue continues at a very modest pace.

9.        VILLAGE AT ROSECLIFFE.  The Developer has been advised by the Manager and Solicitor that the blanket easement/covenant in the Homeowners Association Declaration prepared for the Village at Rosecliffe by Knightland Properties, LP is controlling with regard to facilities installed on lots adjacent to those served.  Basically, all utilities per development plan review, run across other properties for underground service.  Otherwise, the Developer is working on completion of "punch list" items. 

10.      WOODSPRING MEADOWS (STEINHAUER TRACT).  Construction in this John Garis thirty-two (32) unit townhouse development along Clymer Avenue is proceeding one unit at a time.

11.      HARLEYSVILLE SAVINGS BANK.  The legal aspects have been completed by the Solicitor.  The contractor is proceeding with site work and replacement of existing facilities.  Weather and rock has impeded progress.

12.      UNIVEST BANK, ROUTE 113.  (A) The Service and Escrow Agreements as returned in "marked-up" format by legal counsel for Univest have been revised by the Solicitor and resubmitted on June 17, 2009.  On July 6, 2009, the executed Agreements were received by the Solicitor and hand delivered to the Manager for signature at the Authority meeting on July 16, 2009.  Along with the Agreements, a check was enclosed representing payment in full of the fees due.  (B) Three Easement Agreements are required with regard to this development.  The Solicitor has received the legal descriptions and plot plan attachments for Easement Agreement preparation.  By reason of property line realignment, however, current parcel numbers and deed references are required for Agreement completion.

13.      COUNTY LINE ROAD W/S MAIN REPLACEMENT.  The proposed replacement of the water and sanitary sewer line on the Telford side of County Line Road is now projected to commence near the end of July.  As referenced, a PennDOT permit has been obtained.  A cross trench lateral connection to the Landis Supermarket is projected.

14.      BUDGET.  Budget aspects continue to be discussed with the Manager and Engineer in referencing various projects whether active or projected.

15.      SELLERSVILLE WATER INTERCONNECT.  An Interconnect Agreement remains pending with the Solicitor.

16.      WELL NO. 4 LITIGATION.  (A) Supreme Court of Pennsylvania.  The Supreme Court of Pennsylvania has not rendered a decision on the Petition for Allowance of Appeal filed by M&M Stone Co. on January 5, 2009.  (B) United States District Court. (i) The Court has not ruled on the Motions to Dismiss the Amended Complaint as filed by all party defendants.  (ii) As previously indicated, M&M has made a request to Judge Perkin for permission to conduct a Well No. 4 pump test.  A written response was submitted by Siana, Bellwoar & McAndrew shortly thereafter.  Subsequently, counsel for M&M Stone Co. submitted two letters to Judge Perkin on June 11, 2009 to further embellish the pump test request.  On June 30, 2009, Andrew Bellwoar, Esq. submitted response to said correspondence following extensive conference with the Manager and Solicitor to assure accuracy of all detail referenced to Judge Perkin. (C) Bucks County Litigation. There has been no activity.  It is projected that there will be no activity until there is a determination in the pending federal suit.  (D) Temporary Discharge Approval.  On July 2, 2009, the Solicitor filed TBA's Post Hearing Brief in compliance with Judge Labuskes Order directing a July 6, 2009 due date.  On July 6, 2009, DEP filed its Post Hearing Brief, a copy of which has been submitted to the Manager.  M&M's Reply Brief is due August 4, 2009 and a Sur Reply Brief by DEP/TBA is due August 31, 2009.

17.      ARSENIC REMEDIATION.  The arsenic remediation design for Well No. 4 is complete and awaits implementation.

18.      M&M LAND DEVELOPMENT.  There continues to be no contact from M&M following review meeting on July 22, 2008.

19.      SOUTH SEWERAGE LIFT STATION.  There is no activity to report since a proposal on the development of the MetroDevelopment Co./Souderton Area School District property has not been presented.

20.      GIS MAPPING.  Data is still being collected for the GIS water system mapping completion.

21.      WEST ROCKHILL TOWNSHIP PROPOSALS.  There remains no contact in response to the West Rockhill Township proposal for participation in the PWTA facility.

22.      TEVA.  The Solicitor has received and reviewed the comprehensive CKS submission dated June 17, 2009 referencing plan review (third) of the water and sanitary sewer system proposed for the TEVA Pharmaceutical Facility Expansion Project. Issues requiring resolution consist of inspection, escrow, and number of required sanitary sewer EDUs.  At review meeting with the Manager and Engineer, it was determined that a resolution meeting with all parties including legal counsel should be scheduled.

23.      TMDLs.  (A)  The Solicitor continues to review extensive submissions pertaining to all TMDL aspects.  (B) By Opinion and Order dated June 19, 2009, the Environmental Hearing Board denied DEP request to dismiss the TBA TMDL Appeal by reason of lack of timely filing.  (C) The hearing on the Board's jurisdiction remains pending for August 17, 18 and 19, 2009 and on August 21, 2009 if necessary.  The testimony of EPA staff person Jon Capacasa has been scheduled for September 3, 2009 with motion to preclude his testimony denied as premature.  (D)  The Manager and Solicitor attended depositions of DEP personnel conducted in Harrisburg on June 16, 22 and 25, 2009.  (E) The Environmental Hearing Board has granted special leave to conduct the deposition of Travis Stoe on July 16, 2009 since illness of counsel precluded completion by June 30, 2009 in accordance with prior Order.

24.      LUTHERAN COMMUNITY AT TELFORD.  Revised preliminary plans as submitted by the Lutheran Community at Telford have been reviewed by CKS.  Comprehensive written comments have been received and reviewed by the Solicitor.  The proposal will be submitted to the Telford Borough Planning Commission on July 14, 2009 for local administrative review.

25.      SANITARY SEWER RELINING PROJECT.  The documents enclosed with the Notice of Intent to Award have been completed, signed and returned by SWERP, Inc.  A preconstruction meeting was conducted on July 2, 2009.  The work on the contract is to be completed within 30 calendar days from the date of the "Notice to Proceed."

26.      STREAM BANK STABILIZATION.  (A)  The bid opening was held on June 25, 2009.  A low bid in the amount of $47,270.65 was submitted by Enviro-Air Technologies Incorporated of Coopersburg, PA.  CKS has determined the bid to be in order and submitted by a qualified contractor.  It is recommended that the contract be awarded at the July 16, 2009 Authority meeting.

27.      TAPPING FEE CALCULATION.  Review meetings continue with the Engineer who is working on a format for water and sanitary sewer use regulation.  The Telford Borough ordinance will also require revision.

28.      2009 CONSUMER CONFIDENCE REPORT.  The 2009 Consumer Confidence Report was reviewed by the Authority and timely submitted for compliance with the July 1, 2009 reporting date.  Accordingly, this represents a completed item and will be deleted from further report.

29.      WELL NO. 6.  (A) Three replacement fittings have been received and installed in the presence of CKS personnel.  The Engineer is not satisfied with the replacement castings and has submitted an email request for cut sheets.  (B) The Engineer is preparing a Media Replacement Comparison Report with a recommendation for the July 16, 2009 Authority meeting.  (C)  CKS is preparing cost estimates for all backwash disposal options.  This will assist with a decision required by the Authority Board.

Mark Weand reported there will be a partial dedication of the sanitary sewer line at the Coventry Meadows I development.  The agreements for Univest Bank are being signed tonight.  The easement agreements are being prepared.

 

ENGINEER'S REPORT:

 

Patrick DiGangi reported the sewer lines are being cleaned and tv'ed in preparation of the Sanitary Sewer Relining Project.  He also reported the Lutheran Community at Telford is proceeding with the Land Development planning process.  A presentation was made to the Planning Commission earlier this week.

 

MANAGER'S REPORT:   

 

•·    Reviewed various building / zoning permit applications and land development plans with the Zoning Officer and the Solicitor.

  ·    Attended various meetings with regard to Borough Council and Telford Borough Authority.

•·    Attended the Bucks County Consortium Meeting.

•·    Attended the Pennsylvania Downtown Center Townie Award Dinner in Johnstown.

•·    Attended the Heritage Conservancy Annual Garden Party and received their Heritage Partnership Award.

•·    Attended the Partnership TMA Annual Meeting.

•·    Met with our engineer to coordinate preparation of the Wellhead Protection GIS Overlay Plan for our zoning ordinance.

•·    Coordinated a meeting regarding final Zoning Ordinance revisions and proposed adoption.

•·    Met with the Bucks County TMA to discuss rail restoration and other transportation issues.

 

OTHER BUSINESS: 

 

A Moll / Diehl motion was carried unanimously (3-0) approving the water increase from $2.60 per 1,000 gallons to $2.85 per 1,000 gallons.  This rate increase is effective as of the 11/1/2008 billing.

 

A Moll / Diehl motion was carried unanimously (3-0) authorizing the signing of the checks.
