The Telford Borough Authority meeting held this date was called to order at 6:00 p.m. by Chairman Timothy Hagey with the following members in attendance: Abram Diehl and Nelson Moll. Thomas Taglang was absent. Also present were Borough Manager Mark D. Fournier, Recording Secretary Cathy Fried, Solicitor Mark E. Weand, Jr., and Engineer Patrick DiGangi.
A Diehl / Moll motion carried unanimously (3-0) approving the May 7, 2009 minutes. A Moll / Diehl motion carried unanimously (3-0) approving the amended May 21, 2009 minutes.

DISCUSSION ITEMS:
1. Stream Bank Stabilization Project Update:
Engineer Patrick DiGangi reported there are five (5) locations involved with the Stream Bank Stabilization Project associated with Well #6. There is a mandatory pre-bid meeting scheduled for June 18th with the bid opening on June 25th. He also reported all easements have been received and recorded. The recommendation for the successful bidder will be presented at the next Authority meeting.
2. TMDL Update:
Solicitor Mark Weand reported the hearing on jurisdiction has been rescheduled for August 17th to the 21st if necessary. The deadline for discovery has been extended to June 30th. DEP depositions have been scheduled for June 16th, June 22nd and June 25th in Harrisburg and Mark Fournier and Mark Weand will attend.
3. Interzone Transfer Phase II Update:
Patrick DiGangi reported the project is nearing completion. The final item is road restoration that will probably begin this week. Mark Fournier commented the project is moving along very well.
4. M&M Stone Quarry Update:
Solicitor Mark Weand reported the PA Supreme Court has not made its decision as of this date. There has been no response to the motions to dismiss in the federal litigation matter. M&M Stone Quarry has requested a pump test of Well #4 to which Telford Borough Authority has made objection. Mark Fournier distributed an updated accounting of funds expended for litigating this matter. Regarding the temporary discharge permit, on May 29th the court decision was made that DEP and Telford Borough Authority submit their post hearing briefs by July 6th.
REPORTS:
TREASURER REPORT: accepted as presented
WATER DEPARTMENT REPORT:
WATER
1. Wells - Daily maintenance and record keeping were performed. Samples were dawn and tested as required.
2. GIS Mapping - GIS Mapping of the water system continues as staff time allows.
3. Well #6 - At this time, there has been no progress by Siemens in regard to replacing the leaking fittings in the Arsenic Treatment system. Also, we are exploring various options to address the iron levels in the backwash water.
4. Distribution System Repairs - On May 12th we replaced a leaking service to 209 S. Main Street. On May 27th we replaced the water service at 255 N. Main Street.
5. New Services - On May 13th we installed a new water service for the Lutheran Home duplex at Washington Street and Crestview Drive. On May 14th - 15th we installed a new 6" main at the Telford Fire House to supply their proposed fire sprinkler system.
6. Distribution System Flushing - On May 19th we began our annual flushing of the water mains and hydrants. We are approximately 60% complete and expect to finish by the end of June.
Sewer
1. Collection System - See collection system operator's report.
2. GIS Mapping - GIS Mapping of the sewer system continues as staff time allows.
3. 2009 Sanitary Sewer Diversion Project - All sewer main, manhole and water main construction work is complete. The contractor, Passerini & Sons, Inc., must install the final trench restoration to complete this project.
Mark Fournier reported the public works department is cleaning up the service main patching on Main Street.
They continue to flush according to schedule. They will start the project on Main Street in early July that involves water and sewer service on Main Street between Church Road and Lenape Lane.
COLLECTION SYSTEM REPORT:
LIFT STATIONS:
I checked daily, cleaned out grease and installed a five pound block of bacteria on a rope at the South Lift Station.
I checked the North Lift Station daily and replaced the bacteria block.
I had trouble with the alarm system at the South Lift Station. It was not sending the return test signal back to American Security. American Security checked out their equipment and couldn't find anything wrong; then suddenly, it started working again.
While we are on the subject of alarm systems, our agreement with American Security expires in July and I was thinking we should look into the same system we have for the wells. The auto dialers at the wells call Todd's cell phone or any number we program into it. The system we have now with the lift stations, American Security, answers the dialers from the lift station and then American Security calls me. The price we paid American Security last year was $800.00. We would have to get new auto dialers for both lift stations. Swartley's Electric is getting a price for me.
HOME INSPECTIONS:
I made forty inspections during the month of May resulting in 3 violations.
Second notices were sent to residents on N. Washington Street, Fulton Avenue, E. Ridge Avenue and E. Church Road.
MAINS:
I downloaded data from isco meters and e-mailed it to T J at CKS.
K & A finished cleaning mains as part of our preventative maintenance program.
I attended a pre-bid meeting and the bid opening for the Pipeline Relining Project.
MS4:
I shot GPS points of all the inlets in the Borough and e-mailed them to Chris Faino at CKS.
We received the inlet marks and plan to start doing inlet inspections in June.
MISCELLANEOUS:
I attended a PA One Call safety seminar in Kimberton.
I attended a E.P.W.P.C.O.A. meeting with Mark Fournier and Dan Wurst at Kennett Square.
I read water meters for settlement and read the wells for Todd Mathe while he and Chris Haddon were flushing the water system.
I put together a desk for Pamela Coleman at Souderton-Telford Main Streets.
Mark Fournier reported a meeting was held with Public Works Director Donald Beck and Sewer Department Foreman Robert Kratz regarding American Security Systems who may be replaced by an automatic dialer system. They have researched two (2) other systems.
WASTEWATER TREATMENT REPORT:
Operations
•· Total effluent flows recorded for the month of May was 25,462,000 gallons for an average daily flow of 821,400 gallons per day.
•· We generated 96 tons of Bio-Solids for the month of May.
•· Checked stream and outfall area on a weekly basis.
•· There were no violations to report on our April 2009 DMR.
•· Swartley Brothers, Inc. came in and continued to replace electrical components on various equipment around the plant as was considered necessary from a mechanical or safety aspect.
•· We had one storm mode event in the month of April to report. During this event Franconia Township exceeded their Addendum 8 agreement for hourly peak flow registered at our treatment facility. Details of these events were placed in your monthly board packets for your review.
•· Gary's Septic hauled grease into the plant from our South Lift Station. We disposed of the grease in our #2 Digester.
•· LRM was in and replaced the sensor in our chlorine leak detector unit as required.
Maintenance
•· Eastern Environmental, Inc. was in over the course of three weeks and replaced 4 main shafts and all the appropriate bearings, couplings and covers on the East side and West side Oxidation Ditch Aerator units. The scope of this work covered half of the Oxidation Ditch Aerators. During this major event all the parties involved worked well together and no major issues developed that compromised our operation, or affected our effluent discharge at any time. Thanks for a job well done to all the personnel who had a role in this project.
•· We replaced a tension spring on Final Clarifier #1 sweep arm assembly as required.
•· We took Blower #3 out of service. We sent the blower over to Sampey's to be overhauled as required.
•· We remodeled the Control Building bathroom at the plant. We installed a new water conserving toilet and replaced the existing sink and faucet assembly. We also put a new coat of paint on various components found in the washroom.
Personnel
•· I had the opportunity to attend the EPWPCOA May meeting at the Avondale WWTP along with Mark Fournier and Robert Kratz.
Mark Fournier reported four (4) shafts have been replaced by Eastern Environmental Contractors at the Wastewater Treatment Facility and were put back into service with no problems.
PWTA REPORT: We received the written monthly report for the file.
SOLICITOR'S REPORT:
1. WELLHEAD PROTECTION PROGRAM. There remains no Township contact. This item, however, will continue to be referenced by reason of the importance of the Wellhead Protection Program to the Authority.
2. WWTF. Installation of the oxidation ditch shaft has been implemented. By reason of damage, the gear box must be rebuilt. Otherwise, operation aspects and facility related matters continue to be reviewed with the Manager and Engineer.
3. INFLOW AND INFILTRATION. The Authority staff in conjunction with CKS personnel is currently collecting data on County Line Road. As indicated, the next I&I Abatement Plan Semi-Annual Status Report is due September 30, 2009.
4. HILLTOWN INTERCONNECT AGREEMENT. An Interconnect Agreement with the Hilltown Township Water and Sewer Authority remains pending.
5. INTERZONE TRANSFER PROJECT PHASE II (RELIANCE ROAD SURCHARGE). During the course of this project, easement detail and other construction aspects have been reviewed with the Manager and Engineer. The Solicitor participated in a site inspection with the Manager. The storm sewer failure and water line relocation have been addressed. The project went well with reference to accommodation of affected property owners.
6. COVENTRY MEADOWS I. The current issue is a partial dedication of the sanitary sewer line in Keystone Drive to service residences with failed systems. The Engineer has initiated a follow-up contact. There has been no response from the Developer.
7. COVENTRY MEADOWS II (METZGER TRACT). As previously referenced, the Service and Escrow Agreements have not been returned by Developer's legal counsel. Accordingly, there continues to be no update.
8. WISTERIA COURT (KONYK TRACT). Sales and construction remain limited with regard to this John Garis nine lot subdivision along Clymer Avenue.
9. VILLAGE AT ROSECLIFFE. The issue involving the location of laterals and vent stacks installed on adjacent lots to those lots they actually serve has been reviewed with the Manager and Engineer. The Homeowners Association Declaration prepared for the Village at Rosecliffe by Knightland Properties, LP has been reviewed by the Solicitor. Said Declaration does provide that the units (lots) are subject to easements in favor of the Authority. A review of the development plan indicates that all utilities run across other properties for underground service. Accordingly, it would appear that the blanket easement/covenant controls. The Solicitor will initiate a contact with the Developer for resolution.
10. WOODSPRING MEADOWS (STEINHAUER TRACT). There remains nothing to report with regard to this John Garis thirty-two (32) unit townhouse development along Clymer Avenue.
11. HARLEYSVILLE SAVINGS BANK. As reported, the Service and Escrow Agreements have been completed. Construction has commenced but is proceeding slowly by reason of weather conditions.
12. UNIVEST BANK, ROUTE 113. The Service and Escrow Agreements as completed by the Solicitor have been returned in "marked up" format by legal counsel for Univest. Since the requested editorial changes do not affect substance, the Agreements will be revised by the Solicitor and returned for execution. Easement aspects continue under discussion with the Manager and Engineer as well as with CKS and Urwiler & Walter.
13. COUNTY LINE ROAD W/S MAIN REPLACEMENT. The proposed replacement of the water and sanitary sewer line on the Telford side of County Line Road is projected to commence in July. This represents a standard replacement as breaks occur on occasion. The Authority has received the PennDOT permit providing for three months to complete the work. The project encompasses a cross trench lateral connection to the Landis Supermarket property to coordinate Authority work with Landis land development.
14. BUDGET. Budget related matters are routinely discussed with the Manager as various projects and issues arise.
15. SELLERSVILLE WATER INTERCONNECT. An Interconnect Agreement remains pending with the Solicitor.
16. WELL NO. 4 LITIGATION. (A) Supreme Court of Pennsylvania. The Supreme Court of Pennsylvania has not rendered a decision on the Petition for Allowance of Appeal filed by M&M Stone Co. on January 5, 2009. (B) United States District Court. The Court has not ruled on the Motions to Dismiss the Amended Complaint as filed by all party defendants. A request, however, has been made by M&M to Judge Perkin (the magisterial judge assigned to this case) for permission to conduct a Well No. 4 pump test. This request was the subject of a conference call in which the Solicitor participated voicing strong objection. A comprehensive written response in which the Solicitor and Manager participated with input has been submitted by Siana, Bellwoar & McAndrew to Judge Perkin. (C) Bucks County Litigation. There has been no activity. It is projected that there will be no activity until there is a determination in the pending federal suit. (D) Temporary Discharge Approval. As previously referenced, the hearing on this M&M Stone Co. Appeal was conducted on May 7, 2009. Subsequently, Judge Labuskes entered an Order dated May 29, 2009 in which it is set forth that the Department's and TBA's Post-Hearing Briefs are due on or before July 6, 2009 with M&M's Reply Brief due August 4, 2009 and a DEP/TBA Sur Reply Brief due August 31, 2009.
17. ARSENIC REMEDIATION. As previously referenced, CKS has prepared an arsenic remediation design for Well No. 4 which awaits implementation.
18. M&M LAND DEVELOPMENT. There continues to be no contact from M&M following review meeting on July 22, 2008.
19. SOUTH SEWERAGE LIFT STATION. The exchange of flows by gravity to eliminate two existing lift stations continues to remain a Manager agenda item for implementation at the appropriate time.
20. GIS MAPPING. The GIS water system mapping requires completion. A considerable amount of water and storm sewer data is being collected.
21. WEST ROCKHILL TOWNSHIP PROPOSALS. The Solicitor has received no contact since last report pertaining to PWTA activities in response to West Rockhill Township proposals for participation.
22. TEVA. The Engineer has engaged in considerable contact with TEVA in an attempt to resolve the sanitary sewer EDU requirement. The Authority has calculated that 19 EDUs are required on existing usage. TEVA calculates that 152 EDUs will be required for the proposed expansion. At issue also is resistance to Authority inspection of the proposed force main to be constructed and owned by TEVA. This force main, which is subject to breakage and passes under a creek will, however, discharge into the Authority sanitary sewer system.
23. TMDLs. (A) Extensive email submissions pertaining to all TMDL aspects continue to be reviewed by the Solicitor on receipt for participation. (B) By Court Order dated May 22, 2009, the hearing on the Board's jurisdiction scheduled for June 29, 2009 to July 2, 2009 was canceled. The hearing has been rescheduled to take place on August 17, 18 and 19, 2009 and on August 21, 2009 if necessary. The time for completion of discovery was extended to June 30, 2009. The Department has been directed to file its Pre-Hearing Memorandum on or before July 15, 2009. Appellants have been directed to submit their responsive Pre-Hearing Memorandum on or before July 29, 2009. (C) Depositions of DEP personnel have been scheduled for June 16, 22 and 25, 2009 in Harrisburg. The Solicitor and Manager will attend for participation as required.
24. LUTHERAN COMMUNITY AT TELFORD. The Lutheran Community intends to resubmit a development plan for CKS review.
25. SANITARY SEWER RELINING PROJECT. The Solicitor attended the bid opening with the Manager and Engineer on May 19, 2009. On May 21, 2009, the Authority voted to award the contract to SWERP, Inc. The Solicitor has reviewed the Notice of Intent to Award enclosing documents which must be completed, executed and returned within fourteen (14) days of notice dated May 22, 2009.
26. STREAM BANK STABILIZATION. (A) The bid documents as completed by CKS require a mandatory pre-bid meeting on June 18, 2009 with bid opening scheduled for June 25, 2009. To date, seven contract documents have been purchased by prospective bidders. (B) The four Easement Agreements were recorded with the Bucks County Recorder of Deeds on May 22, 2009. Recorded copies were submitted to the Manager for record retention. A copy was submitted to each of the four grantor/owners. 27.
27. TAPPING FEE CALCULATION. The Engineer continues to work on a format for water and sanitary sewer use regulation. Review meetings have addressed the status and content.
28. 2009 CONSUMER CONFIDENCE REPORT. CKS has completed the 2009 Consumer Confidence Report. Thirty-four hundred (3,400) copies are currently being printed for submission to the Authority office on June 15, 2009. Submission will be made by the July 1, 2009 reporting date.
29. WELL NO. 6 FITTINGS. Three replacement fittings have been received for installation. The quality is being assessed. The extent of further replacement and manufacturer/supplier compliance with warranty commitments will be determined.
Mark Weand reported the Univest Service and Escrow Agreements have been received from their attorney. There are a few minor revisions and Mark Weand indicated he will revise the agreements as requested and return them to the attorney for Univest for signatures.
ENGINEER'S REPORT: We received a written monthly report for the file.
Patrick DiGangi reported the following:
Consumer Confidence Reports have been prepared for mailing and Mark Fournier distributed a copy to each Authority Board member.
Well #6 - A meeting was held with Siemens to request a proposal for media replacement with a performance guarantee. This information has been received. Patrick DiGangi will review, present an analysis and make a recommendation to the Authority. The fittings have been delivered and the replacement is scheduled for June 24th. CKS is also exploring options for backwash alternatives that include tying into the sanitary sewer system or reusing the water.
First Service Bank - CKS presented a review letter to the developer listing a few items to be corrected.
Village of Rosecliffe - CKS is in the process of having the developer complete items on the punch list.
TEVA - TEVA has submitted revised planning modules. TEVA has revised the number of requested EDU's from 200 to 152 and does not want inspection of their facilities. Mark Fournier commented TEVA is basically asking Patrick DiGangi to summarize Telford Borough Authority's position.
MANAGER'S REPORT:
•· Met with the Authority Engineer and Solicitor to coordinate various project reviews and construction projects.
•· Coordinated plan reviews of various projects needing water and sewer service.
•· Attended the Environmental Hearing Board case with M&M Stone Quarry vs. DEP and testified on behalf of DEP and TBA.
•· Attended depositions of DEP personnel in Norristown and Harrisburg with regard to the TMDL lawsuit.
•· Held a pre-bid meeting and bid opening for the Sanitary Sewer Pipe Relining Project.
•· Coordinated the bid preparation and advertising for the Stream Bank Stabilization Project.
•· Attended the Eastern Pennsylvania Water Pollution Control Operators Association Spring meeting at the Avondale Wastewater Treatment Facility.
•· Coordinated the Sanitary Sewer Diversion Project property and roadway restoration with the Engineer and Contractor.
Nelson Moll asked what effect the going out of business of Oldcastle Glass and Keystone Findings will have on income. Mark Fournier responded he does not feel there will be a significant impact on income.
OTHER BUSINESS:
Mark Fournier reported that David Fennimore of Northeast Data, Inc. is working on a feasibility study for well development. The study may possibly be presented at the next Authority meeting. Mark further explained the factors to be considered in choosing a well site.
A Diehl / Moll motion was carried unanimously (3-0) authorizing the signing of the checks.
