February 5, 2009 Workshop

 

The Telford Borough Authority workshop meeting held this date was called to order at 6:01 p.m. by Chairman Timothy Hagey with the following members in attendance:  Abram Diehl and Nelson Moll.  Thomas Taglang was absent.  Also present were Borough Manager Mark D. Fournier, Recording Secretary Cathy Fried, Engineer Patrick DiGangi, and Solicitor Mark Weand.

DISCUSSION ITEMS:

1.         TMDL Update:

Solicitor Mark Weand reported he filed an appeal with the Environmental Hearing Board.  The Authority served interrogatories on DEP and received answers.  The answers have been forwarded to Attorney John Hall.  Today Mark Weand received interrogatories from DEP and a directive to produce certain documents.  He is moving along with the discovery process.  John Hines, DEP is tentatively scheduled for deposition on February 24.  Mark Weand and Mark Fournier will be attending the deposition.  The deposition of Bill Brown of DEP has not yet been scheduled.

2.         M&M Stone Quarry Update:

 Mark Weand reported M&M filed a petition with the PA Supreme Court to which he has filed an answer.  It is his continued opinion that M&M has not met the standards for their appeal to be heard.  There is no response from the Supreme Court as of this time.  Regarding the federal court, the second motion to dismiss remains pending.     

3.         Arsenic Level Discussion:

Engineer Patrick DiGangi reported he telephoned and e-mailed Siemens and Riordon Materials regarding Well #6 and the operation of other wells for a proposal to replace the media.  He did talk to another equipment supplier that also replaces media.  Patrick DiGangi also mentioned the backwash discharge permit.  He questions the need for this permit.  The permit has limits for total suspended solids, arsenic, iron and phosphorous that must be tested every month.  Abram Diehl referred to a previous discussion on the maximum level of arsenic to be established by TBA. The maximum level set by TBA is non-detect.  Patrick DiGangi suggested that adjusting the maximum level of arsenic is worth considering since we had breakthrough at 11 months and media replacement is rather expensive.  Timothy Hagey commented TBA directed the maximum level be designed to be non-detect from an operational standpoint, and non-detect should be the standard to be achieved.  However, Chairman Hagey recognized the extreme cost to replace the media and it may be worthy of reconsideration once more information is gathered by the engineer and staff.

4.         Award of Interzone Transfer Project, Phase II:

Patrick DiGangi reported the bid opening was held January 28th.  This project is to alleviate the back-up in Reliance Road.  There were 16 bidders with Passerini & Sons, Inc. submitting the lowest bid at $112,860.50.  He recommended TBA accept the bid and award the project to Passerini & Sons, Inc.

A Moll / Diehl motion was carried unanimously (3-0) to award the Interzone Transfer Project, Phase II to Passerini & Sons, Inc. in the amount of $112,860.50.

5.         Univest Corp. Plan Approval:

Mark Fournier reported this plan is ready for approval.  This project involves tearing down the existing operations building and the existing bank building and the building of a new bank.  A convenience store is also proposed on a new lot.

A Diehl / Moll motion was carried unanimously (3-0) to approve the Subdivision / Land Development Plan subject to the comments of the Manager, Solicitor, and Engineer and to authorize the appropriate officials to sign the appropriate agreements.

6.         West Rockhill Township Letter:

Timothy Hagey feels this matter should be further discussed at the February 19th Authority meeting and that TBA should respond to this letter at that time.

7.         Tapping Fee Study:

Patrick DiGangi distributed the Tapping Fee Study Draft and the Authority discussed the results of the Study.  It was the general consensus of the Authority that Patrick DiGangi remove the word "draft" and this document be utilized as the 2009 Tapping Fee Study.  Further action will be considered at the February 19, 2009 meeting.
