November 6, 2008 Workshop

 

 

The Telford Borough Authority workshop meeting held this date was called to order at 6:01 p.m. by Chairman Timothy Hagey with the following members in attendance:  Thomas Taglang, Abram Diehl and Nelson Moll.  Also present were Borough Manager Mark D. Fournier, Recording Secretary Cathy Fried, Engineer Patrick DiGangi, and Solicitor Mark Weand.

DISCUSSION ITEMS:

 

1.         Budget Presentation:

 

Manager Mark Fournier began the review of the proposed 2009 Budget by explaining the calculations include an increase of $0.25/1,000 gallon.  He briefly highlighted revenue and the fact that without an increase for water rate, it will not be possible to increase water capital.  Mark Fournier explained it is not necessary at this time to make any adjustment to the sewer rate. 

The Authority Board discussed the probability of TEVA connecting for water service.  Mark Fournier reported he had a meeting with TEVA regarding possible water service and increasing their EDU's for sewer service.  Mark Fournier, Mark Weand, Patrick DiGangi and David Fennimore will meet November 13th to determine our next steps and to estimate the cost of this project and calculate a time frame for payback. 

   

2.         TMDL Update:

 

Solicitor Mark Weand reported Hall & Associates will meet with the EPA in Washington, D.C. on November 13th.  The focus of the meeting will be peer review and if peer review is granted, Hall & Associates will request the implementation of TMDL's be put on hold or withdrawn.  Telford Borough Authority was not specifically invited to the meeting; however, Mark Weand offered to be available if required. 

3.         M&M Stone Quarry Update:

 

Mark Weand reported that Telford Borough Authority received a favorable decision on October 17th.  M&M Stone Quarry has 30 days to file a petition with the PA Supreme Court requesting to be heard.  However, at this time, M&M Stone filed a petition to reconsider on October 31st with Commonwealth Court.  The reason given for this petition is new evidence. 

 

4.         Dedication of Water and Wastewater Facilities for the Erie Avenue Tract:

 

Mark Weand reported the Ryan Court development is complete.  John Garis has met all his obligations.  Engineer Patrick DiGangi reported a punch list will be done for next March for the Maintenance Bond.

 

A Taglang / Moll motion was carried unanimously (4-0) authorizing the appropriate officials to sign the Grant and Bill of Sale for water and wastewater facilities for the Erie Avenue Tract.

 

5.         Keith Walker - Telford Borough Authority Obligation:

 

A discussion was held regarding the status of sewer customer, Keith Walker. Todd Walker took possession of the property located at 32 Township Line Road to help his brother avoid foreclosure.  Solicitor Mark Weand has received a letter from Todd Walker's attorney, William Cooper, requesting a pay-off figure to satisfy the liens and for possibly a discounted amount for this payment in cash.  It was the general consensus of that Telford Borough Authority expects payment in full and will not settle for less than the amount due.

 

6.         TH Properties Update:

 

TH Properties has accepted payment for Providence II Sanitary Sewer Reimbursement Component Tapping Fees as calculated by Engineer Patrick DiGangi.  Patrick DiGangi reported there was some discussion regarding calculating options and the fact that he had used reasonable standard guidelines.  TH Properties' response was they agree with Telford Borough Authority's calculations.

 Other Business: 

A Diehl / Moll motion was carried unanimously (4-0) approving the signatures of checks.

 

The meeting adjourned at 7:34 p.m. by a Moll / Diehl motion.
