The Telford Borough Authority workshop meeting held this date was called to order at 6:00 p.m. by Chairman Timothy Hagey with the following members in attendance: Thomas Taglang, Abram Diehl and Nelson Moll. Also present were Borough Manager Mark D. Fournier, Recording Secretary Cathy Fried, Engineer Patrick DiGangi, and Solicitor Mark Weand.

DISCUSSION ITEMS:
1. TMDL Update:
Manager Mark Fournier referenced the e-mails he has received this past month and the effort being made to avoid the suit process. This effort involves the request for peer review and the belief that science will prove there is no link between nutrient levels and the decline in micro invertebrates and/or macro invertebrates due to low levels of oxygen caused by algae growth. Solicitor Mark Weand gave Thomas Taglang a brief progress report on this issue. There was a brief discussion concerning the cost of this legal process in relation to the cost of bio-membrane equipment necessary to attempt to meet the TMDL requirements in the event the TMDL's are upheld. Mark Fournier remarked on the impact the TMDL's will have on Borough residents and their probable responses.
2. M&M Quarry Update:
Mark Weand maintains he expects a decision within one (1) to two (2) months regarding the decision handed down by the Commonwealth Court. Mark Weand reported the federal court litigation is a civil rights suit. Some of the motions to dismiss were granted and some were denied. M&M is being given the opportunity to file an amended complaint. Mark Weand also reported that depositions have been scheduled regarding the NPDES water discharge permit case before the Environmental Hearing Board. Mark Fournier's deposition is scheduled for October 14th.
3. THP Reimbursement Request:
Engineer Patrick DiGangi submitted calculations for the THP reimbursement request for Providence I and Providence II. Providence I is ineligible based on the sewer and water service agreement. He distributed the calculations to Authority Board members.
A Taglang / Moll motion was carried unanimously (4-0) to adopt the districts as outlined by CKS Engineers, Inc. for Water Component Tapping Fees and Sewer Reimbursement Component Tapping Fees in their October 2, 2008 Tapping Fee Evaluation Report.
A Moll / Diehl motion was carried unanimously (4-0) setting the Water Reimbursement Component Tapping Fee at $1,373 per dwelling unit or $8.52 per gallon per day as outlined in the CKS Engineers, Inc. Water and Sewer Tapping Fee Evaluation dated October 2, 2008. Further, the Authority Board set the Sewer Reimbursement Component Tapping Fee at $1,634 per dwelling unit or $7.32 per gallon per day as outlined in the CKS Engineers, Inc. Water and Sewer Tapping Evaluation dated October 2, 2008. These fees apply to the appropriate reimbursement district only.
This payment is for the twelve existing properties within the sewer reimbursement area approved for connection as of this date minus a 5% administration charge allowed by Act 57 of 2003.
A Moll / Diehl motion was carried unanimously (4-0) authorizing payment to TH Properties in the amount of $18,627.60 as calculated by CKS Engineers, Inc.
Timothy Hagey asked Patrick DiGangi regarding the progress on the tapping fee study. Patrick DiGangi responded he is working on the study and attempting to document it with more current figures on system size and capacity.
Other Business:
A discussion was held regarding the amount of deposit to be charged for construction meter rental. It was the general consensus that a $400 deposit be charged for construction meters up to 1" and that $1,300 be charged for the 2" and 3" construction meters.
A Moll / Diehl motion was carried unanimously (4-0) to adopt the revised fee resolution.
A Moll / Diehl motion was carried unanimously (4-0) approving the signatures of checks.
