September 4, 2008 Workshop

 

The Telford Borough Authority workshop meeting held this date was called to order at 6:00 p.m. by Chairman Timothy Hagey with the following members in attendance:  Abram Diehl and Nelson Moll.  Thomas Taglang was absent.  Also present were Borough Manager Mark D. Fournier, Recording Secretary Cathy Fried, Engineer Patrick DiGangi, and Solicitor Mark Weand.

DISCUSSION ITEMS:

1.         TMDL Update:

Mark Fournier reported that with the guidance of Attorney John Hall, Mark Weand filed a Notice of appeal on August 29th with the Environmental Hearing Board.  Mark Weand also made a formal request to Steven Johnson for a peer review.  Attorney John Hall is appealing to Senator Casey in an effort to get EPA to act on his report.  Senator Casey is attempting to get other representatives to join him.  Previously, Timothy Hagey suggested testing be done at various locations of Indian Creek and the tributary it discharges into.  Mark Fournier received an estimate of $45,000 as the cost of the testing of six (6) samples.  He will send the proposal to Attorney Steve Hann to see if Lower Salford Township Authority and Franconia Township Authority would consider sharing the cost of these tests if Attorney Hall believes this to be valuable.  Mark Weand reported the proposal was received by Attorney John Hall and he will respond as soon as possible.

2.         M&M Quarry Update:

Mark Weand reported Telford Borough Authority is scheduled to appear before Commonwealth Court on Thursday, September 11th.  The motions to dismiss the appeal filed in Federal Court have not yet been ruled on.  

3.         THP Reimbursement Request:

Mark Fournier reported Kevin Strnad of TH Properties indicated they cannot find all documentation necessary to calculate the reimbursement as requested.  Mr. Strnad asked that TBA supply the engineering costs including inspection costs for Providence I and Providence II after which THP will provide the certified costs to Patrick DiGangi to determine the amount to be reimbursed.   

4.         Erie Avenue:

Mark Weand reported this project cannot be closed because of easement and legal issues.  Mark Fournier reported he has been in contact with developer John Garis to discuss resolving these issues.

5.         TEVA Update:

TEVA has submitted plans that are now being reviewed.  Engineer Patrick DiGangi will be issuing a review letter.  Mark Fournier reported TEVA will be needing more edu's for sewer.  Mark Fournier presented a study made by Spotts, Stevens & McCoy in 2005 regarding the calculation of water and sewer tapping fees.  A discussion was held regarding the calculation of an EDU and how that had been developed.

A Moll / Diehl motion was carried unanimously authorizing CKS Engineers, Inc. to perform an update to the Water and Sewer Tapping Fee study of 2005.

           

Other Business:  none

A Diehl / Moll motion was carried unanimously (3-0) approving the signatures of checks.

The meeting adjourned at 7:13 p.m. by a Moll / Diehl motion.
