The Telford Borough Authority workshop meeting held this date was called to order at 6:00 p.m. by Chairman Timothy Hagey with the following members in attendance: Abram Diehl and Nelson Moll.  Thomas Taglang was absent.  Also present were Borough Manager Mark D. Fournier, Recording Secretary Cathy Fried, Engineer Patrick DiGangi, Solicitor Mark Weand, and Kevin Strnad of T. H. Properties.

DISCUSSION ITEMS:

1.         TMDL Update:

Mark Fournier reported Hall & Associates is trying to determine which members of the coalition will commit to filing a notice of intent (NOI) to sue.  Hall & Associates would like a decision as to whether Telford Borough Authority will participate.  Mark Fournier feels Telford Borough Authority should take this first step.  The cost for this phase including the NOI will be $40,000 to be shared by the involved entities.  Mark Fournier reported that Franconia Township and Lower Salford Township are being represented by of Hamburg, Rubin, Mullin, Maxwell & Lupin for the filing a NOI.  Souderton Borough has decided not to participate at this time because a small portion of the borough is in the affected area.

A Diehl / Moll motion was passed unanimously (3-0) authorizing Manager Mark Fournier to advise Hall & Associates that Telford Borough Authority agrees with their strategy of filing a notice of intent to sue as prepared by Hall & Associates.

2.         M&M Quarry Update:

Mark Fournier feels a decision will be made shortly regarding the appeal in Commonwealth Court.  Oral argument is scheduled for September 11th.  Mark Fournier and Solicitor Mark Weand are scheduled for 9:30 a.m. and will be allowed 7 ½ to 10 minutes.  Mark Weand will yield the allotted time to the DEP attorney to give him the full 15 minutes.  Timothy Hagey felt there is a direct correlation between the water level in thequarry to the water level in well #4.  Mark Weand reported the water loss insurance suit has been settled but he has not received information regarding the resolution.  There was a discussion as to possible end result if Telford Borough Authority and DEP receive a favorable decision from Commonwealth Court thereby ending this matter.  Mark Fournier commented a favorable decision would make the DEP order stand to restore or replace the well.  Engineer Patrick DiGangi questioned if there is the possibility of further appeals.  Mark Weand responded the next and final step would be an appeal to the PA Supreme Court; however, it is not automatic that they would hear such a request.

3.         THP Reimbursement Request:

Mark Fournier reported he, Mark Weand, James Jacquette, and Patrick DiGrangi are trying to come to a decision as to what the law requires regarding reimbursement.  Solicitor Mark Weand reported that Engineer Patrick DiGangi is working on the appropriate formula in order to calculate reimbursement and will need to determine exactly which properties are involved.  Mark Fournier said there are some properties that are already connected and some that potentially could be connected at a future date. Patrick DiGangi reported he will need a certified breakdown of costs from TH Properties for the installation of sanitary sewer and water for Providence I and Providence II, including the costs for inspection.  There was discussion as to the definition of "extension" to determine what properties are subject to reimbursement.  Patrick DiGangi said if the cost breakdown information is received early next week, the reimbursement figures would be available by the next Authority meeting scheduled for August 21st.

Other Business:

A brief discussion was held regarding depreciation of piping as mentioned at prior meetings.  Timothy Hagey remarked the depreciation calculation should better reflect the actual age of pipes being replaced as opposed to accounting standards used by our auditors, Styer & Associates.

A Diehl / Moll motion was carried unanimously (3-0) to ask the auditor to utilize 75 years instead of 50 years when calculating depreciation on sewer and water system infrastructure.

A Diehl / Moll motion was carried unanimously (3-0) approving the signatures of checks.

 

The meeting adjourned at 7:26 p.m. by a Moll / Diehl motion.
