February 7, 2008 Workshop
 

The Telford Borough Authority workshop meeting held this date was called to order at 6:04 p.m. by Chairman Timothy Hagey with the following members in attendance: Abram Diehl and Nelson Moll.  Thomas Taglang was absent.  Also present were Borough Manager Mark D. Fournier, Recording Secretary Cathy Fried, and Engineer Patrick DiGangi.

DISCUSSION ITEMS:

1.         M&M Stone Quarry Appeal Update:

Solicitor Mark Weand reported that Judge Labuskes entered a favorable Opinion on January 31, 2008.  Mark Weand feels the Opinion was written such that it may forestall any further appeals.  He also feels that a final determination of appeals may take one (1) year.  The federal litigation settlement conference call has been scheduled for Tuesday, February 12th.  Regarding the M&M Stone Quarry suit in Federal Court, preliminary contact with all parties to determine if the matter might settle is standard procedure.  Mark Weand feels there is no room for adjustment and we are not offering any adjustment now or at any time in the future.  Mark Weand reported the insurance company attorney, Andy Bellwoar, has mailed a Rule 11 Response Letter, which states M&M Stone Quarry can be held responsible for filing a frivolous law suit. 

2.         Return Sludge Pump Project Update:

Engineer Patrick DiGangi reported that all shop drawings have been reviewed.  Work will begin the second week of February and will be completed by approximately the end of March.  The completion deadline is April 5th.

3.         Development Update:

Erie Avenue - Engineer  Patrick DiGangi reported they have spoken with the developer and the issues required for dedication are being completed. 

            Calvary Church - The as-builts have been received.

The projects currently under construction are Woodspring Meadows, Coventry Meadows I and Rosecliffe.  The two (2) projects in the planning stage are the Delbar Tract and Coventry Meadows II.

The Reliance Road project will be handled by the public works crew.

Manager Mark Fournier distributed a letter from West Rockhill Township concerning their Act 537 plan and the proposed amending of the 1977 agreement.  It was the consensus of the Authority that West Rockhill Township be invited to the March 6th Authority Workshop meeting.

The meeting adjourned at 7:04 p.m. by a Diehl / Moll motion.
